Aside from the exceptions noted below, Kichler® Lighting warrants that
its Products will be free from defects in material and workmanship for one (1)
year from the date of purchase by the Original Purchaser. (2) years for Energy
Star® Products
The exceptions are:
- Landscape product (for details, see Landscape Warranty).
- Ceiling Fans (for details, see Ceiling Fan Warranty).
- Design Pro Series™ LED Cabinet Light models # 12301BRZ, 12301NI, 12301WH,
12303BRZ, 12303NI, 12303WH, 12305BRZ, 12305NI, and 12305WH for normal use
for as long as the original purchaser owns the Product. Normal use means residential
non-commercial use for no more than 6 hours per day in an environment that
does not exceed 25 degrees Celsius (approximately 77 degrees Fahrenheit).
- Stainless steel-finished transformers and the exterior finish on LifeBrite®
outdoor lanterns are warranted for normal use for as long as the Original
Purchaser owns the Product. (“Normal use” means building interior
use in an environment that does not exceed 25 degrees Celsius or outdoor use
where the ambient temperature does not exceed 35 degrees Celsius.)
- There are no warranties on polished brass Product finishes.
- Note: Bulbs carry no warranty.
To replace a Product that has a warranted defect, it will be necessary for
the Original Purchaser to send F.O.B. destination any allegedly defective parts
or Products to the plant designated by Kichler Lighting with PROOF OF PURCHASE,
Original Purchaser’s name, return address, and a description of the claimed
Product defect. To pre-arrange return, call Kichler Lighting Customer Service
at 1-888-659-8809. The cost of labor for the repair or replacement of parts
including removal and reinstallation of the Product will then be the responsibility
of the Purchaser.
If any of the warranted Products are found by Kichler Lighting to be defective,
such Products will, at Kichler Lighting’s sole option and cost, be replaced,
repaired or refunded less an amount directly attributable to consumer’s
prior use of the Product. Kichler Lighting will return the repaired or replaced
Product prepaid.
The parties hereto expressly agree that Purchaser’s sole and exclusive
remedy against Kichler Lighting shall be for the repair, replacement, or refund
of defective Products as provided herein. This warranty is not transferable
whether to heirs, subsequent owners, or otherwise. This warranty does not cover
labor or other costs or expenses to remove or install any defective, repaired
or replaced Product. Goods which may be sold by Kichler Lighting but which are
not manufactured by Kichler Lighting are not warranted by Kichler Lighting,
but are sold only with the warranties, if any, of the manufacturers thereof.
This warranty extends only to Product ownership by the Original Purchaser.
This warranty is void if the Original Purchaser ceases to own the Product.
This warranty does not apply to any Products that have been subjected to misuse,
mishandling, misapplication, connected voltage at more than 5% above standard
North American Voltage, unusual use (“normal use” means building
interior use in an environment that does not exceed 25 degrees Celsius or outdoor
use where the ambient temperature does not exceed 35 degrees Celsius), neglect
(including but not limited to improper maintenance), accident, improper installation,
improper packaging of products returned to Kichler Lighting, modification (including
but not limited to use of unauthorized parts or attachments), or adjustment
or repair.
THIS WARRANTY GIVES YOU THE SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER
RIGHTS WHICH VARY FROM STATE TO STATE. SOME STATES DO NOT ALLOW LIMITATIONS
ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OR LIMITATION OF INCIDENTAL
OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSIONS MAY NOT APPLY
TO YOU.
THE FOREGOING WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED
INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE OR INFRINGEMENT.
ORIGINAL PURCHASER SHALL IN NO EVENT BE ENTITLED TO, AND KICHLER LIGHTING SHALL
NOT BE LIABLE FOR, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF
ANY NATURE, INCLUDING, BUT NOT LIMITED TO, TO LOSS OF PROFIT, PROMOTIONAL AND/OR
MANUFACTURING EXPENSES, OVERHEAD, INJURY TO REPUTATION AND/OR LOSS OF CUSTOMERS.
